Terms of Service

These Terms of Service ("Terms") govern your use of PayrollTimeCalc ("Service"), operated by the PayrollTimeCalc team ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

PayrollTimeCalc is an online tool that calculates estimated work hours and gross pay based on clock-in/clock-out data you provide. The Service is intended for informational and estimation purposes only. It is not a licensed payroll processing service, accounting software, tax filing system, or legal compliance tool.

2. Important Disclaimer — Not Legal or Tax Advice

Results from this tool are estimates only. Overtime laws vary by state, locality, industry, employment classification, and collective bargaining agreement. Do not use this tool as your sole basis for payroll processing. Verify calculations with your state's Department of Labor, a licensed payroll professional, or an employment attorney. We are not liable for payroll errors made in reliance on this tool's output.

We apply the overtime rules you select (US Federal or California). We make no representation that these rules apply to your specific situation, employment classification, or jurisdiction. Many states have overtime rules that differ from both federal law and California law.

3. Free Tier

The free tier provides up to 5 calculations per day per IP address with no account required. We reserve the right to adjust this limit at any time. Free-tier features are provided "as is" with no service level guarantee.

4. Pro Subscription

The Pro subscription is billed monthly at €9 per month via Stripe. Your subscription renews automatically each month unless you cancel. You may cancel at any time — cancellation takes effect at the end of the current billing period. No partial-month refunds are issued for unused time.

Access to Pro features (saved employee profiles, timesheet history, CSV export) requires an active subscription. If your subscription lapses, Pro features are suspended but your saved data is retained for 90 days to allow reactivation. After 90 days, data is permanently deleted.

We reserve the right to change the Pro subscription price with 30 days' notice to your registered email address. If you disagree with a price change, you may cancel before it takes effect.

5. Acceptable Use

You may not use the Service to:

  • Automate requests in ways that exceed rate limits or circumvent the free-tier limit (e.g., rotating IPs, scripted API calls)
  • Reverse-engineer, scrape, or extract data from the Service in bulk
  • Share or resell access to your Pro license key
  • Use the Service for any unlawful purpose
  • Attempt to access other users' data or the administrative interface without authorization

We reserve the right to terminate or restrict access to any account or IP that violates these terms, without notice and without refund.

6. Intellectual Property

All content, software, and design of the Service is owned by PayrollTimeCalc or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, reproduce, or create derivative works of the Service without written permission.

7. Limitation of Liability

To the maximum extent permitted by applicable law, PayrollTimeCalc shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service, including losses resulting from payroll errors made in reliance on the Service's calculations. Our total aggregate liability shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of calculations. We do not guarantee that the Service will be error-free, uninterrupted, or that results will be correct for your specific jurisdiction or employment circumstances.

9. Governing Law

These Terms are governed by the laws of Italy, without regard to conflict of law principles. Any disputes shall be submitted to the courts of competent jurisdiction in Italy, unless mandatory consumer protection laws in your country of residence require otherwise.

10. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date. For material changes affecting Pro subscribers, we will send notice to your registered email address at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance.
